Programme
Criminal Procedure in a Rule of Law. In search of (possible) balances between the antinomic demands of security and justice in the face of crime in a contemporary global society.
Preliminary questions.
1.1.1 The purposes of criminal procedural law in its inextricable relationship with the function of criminal law and the purposes of criminal penalties.
1.1.2 Criminal law and criminal procedure, criminal policy, and criminology. The Joint Science of Criminal Law.
1.1.3. Criminal procedural law as the practical application of constitutional law.
1.2 The model(s) of criminal policy in the face of serious crime, economic-financial crime, transnational organized crime, particularly terrorism, and its difficult compatibility with the purpose of criminal procedural law to protect fundamental individual rights and liberties.
1.3 The defendant, both as a subject of the case endowed with intangible dignity and as an object of the evidence. Means of obtaining evidence - the principle of legality and the principle nemo tenetur se ipsum accusare.
1.4. The "penetration" of the victim in the criminal process. Precedents of a new criminal policy paradigm and its consequences on criminal procedural law.
